Terms and Conditions

1. Acceptance of Terms

By accessing and using SIMPLEX TRUCKING INC's services, you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you may not use our services.

2. Service Description

SIMPLEX TRUCKING INC provides professional transportation services across the United States. Our services include truck transport, fleet transport, and dealer/auction logistics support.

3. Contract Formation

A binding contract is established once you receive a quote from SIMPLEX TRUCKING INC and accept it by requesting pickup. Additional terms may be provided in booking confirmations and shipping agreements.

4. Booking and Cancellation

  • Customers must provide accurate truck, equipment, and location information at booking
  • Cancellations must be made at least 24 hours before scheduled pickup for full refund
  • Cancellations within 24 hours of pickup may incur a cancellation fee (up to 25% of service cost)
  • No cancellations permitted after driver dispatch

5. Payment Terms

  • Payment is due upon receipt of invoice unless credit terms have been previously agreed
  • We accept credit cards, bank transfers, and checks
  • Late payments may result in service suspension and collection actions
  • All prices quoted are in USD and subject to change based on fuel surcharges and market conditions

6. Truck Inspection and Condition

  • Customers are responsible for inspecting their truck or equipment before transport and noting any existing damage
  • SIMPLEX TRUCKING INC will document truck or equipment condition at pickup
  • A final inspection will occur at delivery
  • Claims for damage must be reported within 7 days of delivery

7. Liability and Limitations

  • SIMPLEX TRUCKING INC carries comprehensive insurance coverage for transported trucks and equipment
  • Our liability is limited to the declared value of the truck or equipment, not to exceed the insurance policy limits of $250,000 per unit
  • We are not responsible for damage caused by weather, natural disasters, war, or acts of God
  • SIMPLEX TRUCKING INC is not liable for indirect, consequential, or punitive damages
  • Customers assume risk of loss if the truck or equipment is not declared as insured at time of booking

8. Transit Times and Delays

  • Estimated delivery dates are provided to give customers an approximate timeframe only
  • Delays due to weather, traffic, mechanical issues, or other unforeseen circumstances do not constitute breach of contract
  • SIMPLEX TRUCKING INC is not liable for losses or damages resulting from delays
  • Customers will be notified of significant delays as soon as practically possible

9. Special Requests and Additional Services

  • Expedited delivery, enclosed transport (if available), and other special requests may incur additional fees
  • Special requests must be confirmed in writing before service provision
  • SIMPLEX TRUCKING INC reserves the right to decline special requests that may compromise safety or exceed equipment capabilities

10. Customer Responsibilities

  • Customers must ensure unit keys are available for driver pickup and delivery coordination
  • Customers are responsible for removing personal items from trucks or equipment
  • SIMPLEX TRUCKING INC is not liable for lost or damaged personal items left in trucks or equipment
  • Customers must ensure trucks are in operational condition when drive-on service is required (brakes, steering, etc.)
  • Trucks and equipment must be accessible for pickup at the agreed time and location

11. Driver Authority and Communication

  • SIMPLEX TRUCKING INC drivers are independent contractors or employees authorized to act on behalf of SIMPLEX TRUCKING INC
  • Customers must direct all questions and concerns to SIMPLEX TRUCKING INC customer service, not drivers
  • All communications regarding delivery times, locations, and conditions must be confirmed with SIMPLEX TRUCKING INC in advance

12. Confidentiality

SIMPLEX TRUCKING INC agrees to maintain the confidentiality of customer information and truck or equipment details in accordance with applicable laws and our Privacy Policy.

13. Dispute Resolution

  • Any disputes arising from or relating to these terms shall first be subject to good faith negotiation between parties
  • If negotiation fails, disputes shall be resolved through binding arbitration
  • Arbitration shall be conducted under American Arbitration Association (AAA) rules
  • Disputes will be settled by a single arbitrator in the jurisdiction where services were provided
  • Each party bears its own legal fees unless arbitrator determines otherwise

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States and the state in which services are provided, without regard to conflict of law principles.

15. Modifications to Terms

SIMPLEX TRUCKING INC reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of modified terms.

16. Entire Agreement

These Terms and Conditions, along with our Privacy Policy and any written service agreements, constitute the entire agreement between SIMPLEX TRUCKING INC and the customer and supersede all prior understandings and negotiations.

17. Severability

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
